CR&S provides a broad range of bankruptcy related services, providing
representation to debtors, creditors and trustees in connection with cases
under Chapters 7, 11, 12 and 13 of the United States Bankruptcy Code, state
court insolvency proceedings, and out-of-court debtor/creditor workouts. We
have extensive experience in all aspects of bankruptcy and insolvency law,
ranging from individual bankruptcy filings to complex commercial reorganizations.
Reorganizations: CR&S has represented debtors, creditors, trustees and
committees in connection with many chapter 11 reorganization cases. Recently,
CR&S served as counsel to Citicorp, U.S.A., Inc., as the major secured
lender of Geneva Steel Company.
Individual Bankruptcies: CR&S can assist individuals with financial difficulties
in determining whether filing for bankruptcy protection is their best option
and, if so, whether a Chapter 7, 11, 12 or 13 filing would best serve their
needs.
Trustee Representation: CR&S often represents trustees which have been
appointed to administer bankruptcy estates, both with respect to Chapter 7
liquidations and Chapter 11 reorganizations. Roger G. Segal has served as
a Chapter 7 Trustee in the United States Bankruptcy Court for the District
of Utah since 1975. From 1992 through April 1999, he served as the Chapter
11 trustee for the bankruptcy estate of Bonneville Pacific Corporation, one
of the largest and most complex cases ever to be filed in Utah; in that proceeding
the trustee recovered approximately $200,000,000 in litigation proceeds and
paid creditors in full with interest. CR&S, led by Vernon L. Hopkinson,
served as general counsel to the Trustee in the bankruptcy proceeding.
Out-of-Court Workouts: Often it is desirable for parties to find solutions
to problem loans without filing bankruptcy. CR&S has represented both
debtors and creditors in connection with numerous loan workouts and debt restructuring.
Acquisitions: CR&S can assist parties with negotiating, documenting
and completing the acquisition of assets or businesses from bankruptcy estates
or from insolvent sellers.
Mediation/Arbitration: Vernon L. Hopkinson serves as a mediator/arbitrator
with respect to bankruptcy and insolvency matters and serves as a mediator
appointed by the United States Bankruptcy Court for the District of Utah.
